WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SERVICES OR DELETE YOUR ACCOUNT AND ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.

16. GOVERNING LAW
These Legal Terms are governed by and interpreted following the laws of the United Kingdom, and the use of the United Nations Convention of Contracts for the International Sales of Goods is expressly excluded. If your habitual residence is in the EU, and you are a consumer, you additionally possess the protection provided to you by obligatory provisions of the law in your country to residence. DevSecure Ltd and yourself both agree to submit to the non-exclusive jurisdiction of the courts of London, which means that you may make a claim to defend your consumer protection rights in regards to these Legal Terms in the United Kingdom, or in the EU country in which you reside.
17. DISPUTE RESOLUTION
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a 'Dispute' and collectively, the 'Disputes') brought by either you or us (individually, a 'Party' and collectively, the 'Parties'), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.
Binding Arbitration
Any dispute arising from the relationships between the Parties to these Legal Terms shall be determined by one arbitrator who will be chosen in accordance with the Arbitration and Internal Rules of the European Court of Arbitration being part of the European Centre of Arbitration having its seat in Strasbourg, and which are in force at the time the application for arbitration is filed, and of which adoption of this clause constitutes acceptance. The seat of arbitration shall be Twickenham, England. The language of the proceedings shall be English. Applicable rules of substantive law shall be the law of England.
Restrictions
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilise class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorised use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT OR THE CONTENT OF ANY WEBSITES OR MOBILE APPLICATIONS LINKED TO THE SERVICES AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES, (3) ANY UNAUTHORISED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES, (5) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY, AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES. WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICES, ANY HYPERLINKED WEBSITE, OR ANY WEBSITE OR MOBILE APPLICATION FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND WE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND ANY THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGEMENT AND EXERCISE CAUTION WHERE APPROPRIATE.
20. LIMITATIONS OF LIABILITY
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE
AMOUNT PAID, IF ANY, BY YOU TO US DURING THE three (3) mONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING. CERTAIN US STATE LAWS AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
21. INDEMNIFICATION
You agree to
defend, indemnify, and hold us harmless, including our subsidiaries,
affiliates, and all of our respective officers, agents, partners, and
employees, from and against any loss, damage, liability, claim, or demand, including
reasonable attorneys’ fees and expenses, made by any third party due to or
arising out of: (1) your Contributions; (2) use of the Services; (3) breach of these Legal Terms; (4) any breach of your representations and warranties set forth in these Legal Terms; (5) your violation of the rights of a third party, including but not limited to intellectual property rights; or (6) any overt harmful act toward any other user of the Services with whom you connected via the Services. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defence of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
22. USER DATA
We will maintain
certain data that you transmit to the Services for the purpose of managing the
performance of the Services, as well as data relating to your use of the Services. Although we perform regular routine backups
of data, you are solely responsible for all data that you transmit or that
relates to any activity you have undertaken using the Services. You agree
that we shall have no liability to you for any loss or corruption of any such
data, and you hereby waive any right of action against us arising from any such
loss or corruption of such data.
23. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Services, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SERVICES. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.

25. MISCELLANEOUS
These Legal Terms and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Legal Terms or use of the Services. You agree that these Legal Terms will not be construed against us by virtue of having drafted them. You hereby waive any and all defences you may have based on the electronic form of these Legal Terms and the lack of signing by the parties hereto to execute these Legal Terms.
26. SECURITY, INTELLIGENCE, AND AUTHORISED USE
The Services may include consumer-facing application security tools, application security posture management, vulnerability intelligence, exploitability scoring, risk prioritisation, API access, dashboards, reports, and related security analysis.
For consumer users, you may only use the Services to scan, test, assess, or analyse systems, applications, repositories, APIs, code, or data that you own or are personally authorised to assess.
For business users, you confirm that you have authority to use the Services on behalf of your organisation and that your organisation has the right to submit, scan, enrich, prioritise, or analyse the relevant systems, applications, repositories, APIs, vulnerabilities, code, or data.
You must not use the Services for unauthorised security testing, exploitation, disruption, credential theft, malware activity, unlawful surveillance, data exfiltration, or any activity intended to harm, compromise, or gain unauthorised access to any system, account, network, application, or data.
We may suspend or terminate access where we reasonably believe the Services are being used unlawfully, abusively, or in breach of these Terms.
27. API ACCESS AND DATASET USE
API access by humans, AI systems, and automated tools is permitted within rate limits. The following uses are prohibited:
- Bulk extraction of the underlying dataset by enumerating CVE IDs
- Training machine learning models on DevSecure Intelligence API responses
- Replicating or redistributing the DevSecure Intelligence corpus
- Resale of API responses without an enterprise license
LLMs and AI agents may reference, cite, and call DevSecure Intelligence in real time as a query-time tool. They may not memorize, train on, or rebuild the dataset from API responses. DevSecure Intelligence is a query-time API, not a dataset.
28. NO SECURITY, INTELLIGENCE, OR RISK GUARANTEE
The Services may help identify, prioritise, enrich, score, or manage security risks, vulnerabilities, exposures, exploitability signals, threat intelligence, and related issues.
The Services do not guarantee that all risks, vulnerabilities, threats, exploits, misconfigurations, exposures, or security issues will be detected, prioritised correctly, prevented, remediated, or eliminated.
Any scores, rankings, intelligence outputs, reports, API responses, or recommendations are provided for informational and decision-support purposes only.
Consumer users and business users remain responsible for reviewing results, validating findings, applying appropriate remediation, and maintaining the security of their own systems, applications, data, and environments.
29. AI-Assisted and Autonomous Security Testing Addendum
This AI-Assisted and Autonomous Security Testing Addendum forms part of the DevSecure Terms and Conditions and applies where a Customer uses any DevSecure feature that performs, supports, or enables AI-assisted security testing, autonomous security testing, semi-autonomous security testing, vulnerability validation, code security analysis, application security testing, API testing, infrastructure testing, or related security assessment activity.
This Addendum applies to the DevSecure ASPM platform, DevSecure Intelligence platform, APIs, dashboards, integrations, reports, agents, and any security testing capability made available by DevSecure.
1. Scope of this Addendum
This Addendum applies to features that actively test, analyse, validate, simulate, scan, or assess security issues in Customer systems, code, applications, APIs, repositories, packages, infrastructure, cloud assets, containers, pipelines, or other assets.
DevSecure Intelligence features that only provide vulnerability intelligence, exploitability context, prioritisation, CVSS, EPSS, KEV, RPS, reporting, or passive risk analysis are not active penetration testing unless DevSecure expressly states otherwise.
2. Customer Authorization
Customer represents and warrants that it owns, controls, or has full written authority to test every asset submitted to DevSecure.
Customer must not use DevSecure to test, scan, attack, enumerate, validate, or interact with any third-party asset unless Customer has clear written permission from the asset owner.
Customer is solely responsible for ensuring that all testing is lawful, authorized, and within the approved scope.
DevSecure may suspend, refuse, pause, throttle, or terminate testing where ownership, authorization, scope, or legality is unclear.
3. Approved Targets and Scope
Customer must define the approved testing scope before using any active testing feature.
Approved scope may include, where applicable:
- domains;
- subdomains;
- IP addresses;
- APIs;
- repositories;
- applications;
- cloud accounts;
- containers;
- packages;
- CI/CD pipelines;
- staging environments;
- production environments, only where expressly authorized.
DevSecure must not be used to test assets outside the approved scope.
Customer must ensure that test credentials, test data, rate limits, allow-lists, maintenance windows, and emergency contacts are accurate and current.
4. Autonomous Pentesting Mode
Where DevSecure provides autonomous or semi-autonomous penetration testing features, Customer acknowledges that the Services may plan test steps, interact with approved targets, execute security checks, adapt testing based on observed responses, and generate findings with limited human intervention.
Customer must expressly enable Autonomous Pentesting Mode before any autonomous test begins.
Autonomous Pentesting Mode may only be used against assets that Customer owns, controls, or is expressly authorized to test.
Before testing begins, Customer must define the approved scope, including target domains, subdomains, IP ranges, APIs, environments, credentials, rate limits, test windows, and emergency contacts.
DevSecure may apply safety controls, including target allow-listing, network-level scope restrictions, execution sandboxing, rate limits, audit logs, test session records, prohibited-action controls, and emergency stop controls.
Customer must not use Autonomous Pentesting Mode for denial-of-service testing, social engineering, phishing, malware deployment, credential theft, destructive exploitation, persistence, lateral movement, data exfiltration, or testing of third-party systems without written authorization.
Production testing is permitted only where Customer has expressly included production assets in the approved scope.
Customer remains responsible for confirming that production systems can safely tolerate the test.
DevSecure may pause, throttle, or stop any autonomous test if DevSecure believes the test may exceed scope, affect service availability, expose data, breach law, or create risk to DevSecure, Customer, or any third party.
Autonomous pentesting results may include false positives, false negatives, incomplete findings, or findings requiring human validation.
Customer remains responsible for reviewing findings, validating impact, prioritising remediation, and deciding whether any report is suitable for audit, compliance, procurement, or customer assurance purposes.
DevSecure does not guarantee that Autonomous Pentesting Mode will identify every vulnerability, replace human penetration testing where a human-led test is contractually or legally required, or satisfy every auditor, regulator, insurer, certification body, or customer requirement.
5. Production Testing
Customer acknowledges that security testing against production systems carries operational risk.
Customer is responsible for deciding whether production testing is appropriate.
Where Customer enables testing against production systems, Customer confirms that:
- it has authority to perform the test;
- the target system can tolerate the expected testing activity;
- relevant internal teams have been notified where required;
- appropriate monitoring is in place;
- rollback or incident response processes are available;
- test credentials and test data have been provided where needed.
DevSecure may apply rate limits, scope limits, safety checks, or other controls to reduce operational risk, but Customer remains responsible for approving production testing.
6. Prohibited Use
Customer must not use DevSecure to:
- attack, disrupt, damage, overload, or gain unauthorized access to third-party systems;
- test assets without permission;
- perform denial-of-service activity;
- exfiltrate real user data;
- access systems beyond the approved scope;
- bypass payment, licensing, identity, or access controls except as part of an authorized test;
- use findings for offensive, unlawful, or harmful purposes;
- test critical infrastructure, public services, emergency services, healthcare systems, financial systems, or government systems without written authorization and agreed scope;
- upload malware, stolen credentials, or unlawful data;
- use DevSecure as a general attack platform;
- perform phishing, social engineering, physical intrusion, or credential theft;
- deploy persistence, backdoors, destructive payloads, ransomware, worms, or self-propagating code;
- continue testing after being told to stop by DevSecure, the asset owner, a hosting provider, or a relevant authority.
Violation of this section may result in immediate suspension or termination.
7. AI-Assisted Testing Limitations
Customer acknowledges that AI-assisted security testing is not perfect.
AI-assisted testing may:
- miss vulnerabilities;
- report findings that require human review;
- depend on the quality of the input, configuration, code access, credentials, and scope;
- behave differently across environments;
- require validation, retesting, or manual confirmation;
- be unsuitable for some regulated, safety-critical, or highly sensitive environments.
DevSecure does not guarantee that the Services will identify every vulnerability, eliminate all risk, satisfy every auditor, or replace all forms of human penetration testing.
8. Human Review and Customer Responsibility
Customer is responsible for reviewing all findings, reports, suggested fixes, prioritisation outputs, and remediation guidance before relying on them.
Customer is responsible for deciding whether to accept, reject, suppress, remediate, or escalate any finding.
DevSecure may provide severity, confidence, exploitability, RPS, risk scoring, or prioritisation outputs, but Customer remains responsible for its own security, compliance, risk management, and remediation decisions.
9. Safety Controls
DevSecure may implement safety controls for AI-assisted and autonomous testing, including:
- target allow-listing;
- ownership checks;
- rate limits;
- network scope controls;
- sandboxed execution;
- separation of planning and execution;
- audit logging;
- test session records;
- emergency stop controls;
- abuse detection;
- prompt injection containment;
- restrictions on destructive actions;
- restrictions on credential, secret, and token handling;
- restrictions on data exfiltration;
- restrictions on lateral movement;
- restrictions on persistence;
- restrictions on out-of-scope domains, networks, APIs, and repositories.
Customer must not attempt to bypass these controls.
10. Credentials, Secrets, and Test Data
Customer should provide only the minimum credentials required for the approved test.
Customer must not submit production secrets, private keys, access tokens, passwords, or credentials unless the relevant DevSecure feature is specifically designed to handle them securely and Customer has authorized that use.
Customer is responsible for rotating or revoking test credentials after testing where appropriate.
DevSecure may reject, mask, delete, or refuse to process credentials or secrets that appear unnecessary, unsafe, or outside the approved scope.
11. Customer Data and Personal Data
Where AI-assisted or autonomous testing involves Personal Data, the DevSecure Data Processing Agreement applies.
Customer must not intentionally submit Sensitive Personal Data unless DevSecure has expressly agreed in writing.
Customer should use test data, synthetic data, staging data, or minimized datasets wherever possible.
Customer remains responsible for ensuring that any Personal Data submitted to DevSecure is lawful, necessary, proportionate, and covered by an appropriate legal basis.
12. Third-Party AI and Subprocessors
Some AI-assisted or autonomous features may use third-party AI model providers, sandbox providers, cloud providers, or other subprocessors.
Where such providers process Customer Personal Data, they will be listed in DevSecure's Data Processing Agreement or subprocessor list.
DevSecure will not use Customer Personal Data to train public foundation models.
DevSecure will not intentionally send Customer source code, private repository content, secrets, credentials, or Sensitive Personal Data to external AI model providers unless Customer has enabled a feature that requires such processing and the relevant provider is listed as an approved subprocessor.
13. Reports and Compliance Use
DevSecure may provide reports, findings, evidence, reproduction steps, remediation guidance, confidence levels, exploitability context, and prioritisation outputs.
Customer may use DevSecure reports as part of its internal security, governance, audit, or compliance processes.
DevSecure does not guarantee that any report will satisfy SOC 2, ISO 27001, PCI DSS, Cyber Essentials, CREST, FedRAMP, regulator, auditor, insurer, customer, procurement, or contractual requirements unless DevSecure has expressly agreed this in writing.
Customer is responsible for confirming whether a DevSecure report is acceptable for its specific compliance, assurance, procurement, or audit purpose.
14. Emergency Stop and Incident Handling
Customer must stop testing immediately if it believes testing may be causing instability, unauthorized access, data exposure, service degradation, or other harm.
DevSecure may stop, pause, throttle, or cancel testing at any time where it believes testing may create legal, security, operational, or safety risk.
Customer must notify DevSecure promptly if it becomes aware of any issue caused or suspected to be caused by AI-assisted or autonomous testing.
15. No Offensive Security Warranty
DevSecure provides security testing, prioritisation, validation, and remediation support tools.
DevSecure does not provide any warranty that the Services will make Customer systems secure, compliant, breach-proof, vulnerability-free, or suitable for any particular regulated environment.
16. Suspension
DevSecure may suspend access to AI-assisted or autonomous testing features if:
- Customer tests unauthorized assets;
- Customer exceeds approved scope;
- Customer provides false ownership or authorization information;
- Customer attempts to bypass safety controls;
- testing creates legal, operational, security, or third-party risk;
- continued use may breach law, contract, or this Addendum;
- DevSecure receives a complaint, abuse report, legal notice, cloud provider warning, or law enforcement request related to Customer testing.
17. Customer Indemnity
Customer agrees to defend, indemnify, and hold harmless DevSecure from claims, losses, damages, liabilities, costs, and expenses arising from Customer's unauthorized testing, false scope information, breach of this Addendum, unlawful use of the Services, or testing of assets Customer did not have authority to test.
This section does not limit DevSecure's obligations under the Data Processing Agreement for processing of Personal Data.
18. Conflict
If this Addendum conflicts with the main Terms and Conditions, this Addendum controls for AI-assisted and autonomous security testing matters.
If this Addendum conflicts with the Data Processing Agreement, the Data Processing Agreement controls for Personal Data processing matters.
If this Addendum conflicts with mandatory law, mandatory law controls.
